Terms of Service

Eligibility and Authority

You must be at least 18 years old and have the legal authority to bind your organization to this agreement in order to use the Leadelivery platform. By creating an account, you represent and warrant that you meet these requirements.

Credential and API Key Responsibility

You are responsible for maintaining the confidentiality of your account credentials and API keys (Bearer tokens). Leadelivery is not liable for any unauthorized access to your account or data resulting from your failure to secure your credentials. You agree to notify Leadelivery immediately of any unauthorized use of your account.

Data Legality and Consent

You are solely responsible for the legality of the lead data you collect and distribute through the platform, including obtaining all necessary consent from lead subjects as required by applicable law. Leadelivery does not verify the legality of data submitted to the platform and assumes no liability for your compliance obligations.

Prohibited Uses

You may not use the Leadelivery platform to collect or distribute data in violation of applicable laws, including but not limited to:

• The Telephone Consumer Protection Act (TCPA)
• The CAN-SPAM Act
• State insurance regulations applicable to the jurisdictions in which you operate

Suspension and Termination

Leadelivery reserves the right to suspend or terminate your account if you violate these terms or engage in abusive behavior. Abusive behavior includes, but is not limited to:

• Exceeding published API rate limits
• Submitting spam or fraudulent lead data
• Using the platform for purposes not permitted by these terms

Upon account termination, your lead data is retained for up to 90 days to allow for data export, after which it is permanently deleted.

Service Availability and Warranty Disclaimer

The Leadelivery service is provided “as-is” without warranties of any kind, including warranties of uninterrupted availability. Leadelivery is not liable for losses resulting from service downtime or third-party integration failures, including failures of Twilio, Google Sheets, or Facebook services.

Modification of Terms

Leadelivery may modify these terms at any time. We will provide at least 30 days advance notice of material changes via email to your registered account address. If you do not agree with the modified terms, you may terminate your account before the changes take effect.

Acceptance of Terms

By creating an account or continuing to use the platform after the effective date of updated terms, you accept and agree to be bound by the current Terms of Service.

Data Flow Description

Lead data is ingested via webhook endpoints and Facebook Lead Ads integration, processed according to your campaign rules (including state filtering, delivery caps, and priority settings), and distributed to your configured delivery recipients.

Controller and Processor Roles

You (the Platform User) act as the Data Controller for lead subject information processed through the platform. Leadelivery acts as the Data Processor, processing lead data on your behalf and according to your campaign configurations.

Third-Party Service Disclosures

In the course of providing the distribution service, lead data may be transmitted to the following third-party services:

• Twilio — for SMS and WhatsApp notification delivery to your configured recipients
• Google — for Sheets integration and real-time lead tracking spreadsheets
• Meta/Facebook — for Lead Ads data retrieval when you authorize the integration
• Email service provider — for email notifications to delivery recipients

Meta Platform Compliance

If you connect your Facebook account and use the Facebook Lead Ads integration, you are responsible for ensuring your use of Facebook Lead Ads data complies with Meta Platform Terms and the Facebook Lead Ads Terms of Service.

Data Retention

Leadelivery retains lead data for the duration of your active account and for up to 90 days after account termination or campaign deletion. This retention period exists for data export, legal, and operational purposes.

Limited License to Process Data

By using the platform, you grant Leadelivery a limited license to process, store, and transmit your lead data solely for the purpose of providing the distribution service as configured in your campaigns.

Post-Termination Data Export

Upon account termination, you may request export or deletion of your lead data within the 90-day post-termination retention window by contacting our support team.

Your Data Ownership

You retain ownership of all lead data you upload or collect through the platform, including your campaign configurations, custom field schemas, and any data exported to Google Sheets via the delivery integration.

Platform Intellectual Property

Leadelivery retains ownership of the platform software, interface, APIs, documentation, and all related intellectual property. No rights to the platform technology are transferred to you by your use of the service.

Service Scope

The Leadelivery service includes:

• Lead collection via webhook endpoints and Facebook Lead Ads
• Lead storage within campaign workspaces
• Rule-based distribution (state filtering, caps, priority)
• Notification delivery via email, SMS, and WhatsApp

The service does not include:

• Billing or payment processing
• Advanced analytics or reporting beyond delivery history logs
• Legal compliance auditing
• Direct communication with lead subjects on behalf of the Platform User

US Insurance Market Focus

The Leadelivery platform is designed for the US insurance market. You are responsible for compliance with state-specific insurance regulations in the states where you operate.

Sublicensing Prohibition

You may not sublicense, resell, or redistribute access to the Leadelivery platform or its APIs to third parties without prior written consent from Leadelivery.
